Immigration Law

What Are the Immigration Laws and Policies?

Immigration law governs the entry, stay, and exit of individuals in a country, encompassing a wide range of legal frameworks designed to regulate international migration. In India, immigration laws are primarily governed by the Foreigners Act, 1946, the Immigration Act, 1983, and other related legislation. These laws address issues such as visa applications, citizenship, work permits, deportation, and the regulation of foreign nationals in India.
  • Immigration and Nationality Act (INA): The Immigration and Nationality Act (INA) is the fundamental federal law governing immigration in the United States. It describes the numerous visa types, eligibility requirements, and processes for entering and staying in the nation, and the grounds for deportation.
  • Visa Categories: Numerous visa categories are defined by US immigration law, including family-sponsored visas, employment-based visas, student visas, tourist visas, and others. Each category has its own set of requirements and constraints.
  • Deportation and Removal: The method for removing foreign nationals who are not authorized to remain in the United States is outlined in immigration law. Visa infractions, criminal convictions, and overstaying a visa are grounds for deportation.
  • Asylum and Refugee Policies: Asylum seekers and refugees escaping persecution or violence in their home countries are protected under US law. There is a list of immigration policies that define the procedures for seeking asylum, acquiring refugee status, and relocating to the United States.
  • Naturalization: Naturalization is the process of becoming a citizen of the United States under immigration law. It consists of eligibility requirements, residency requirements, and a citizenship test.
  • Temporary Protected Status (TPS): The TPS is a discretionary immigration benefit available to qualifying foreign citizens from countries experiencing continuing armed conflict, natural disasters, or other unusual circumstances. TPS gives temporary deportation relief and employment authorization.
  • Deferred Action Programs: Certain undocumented people who enter the country, including children, receive work permits and temporary protection from deportation under deferred action programs, such as Deferred Action for Childhood Arrivals (DACA).
  • Employment-Based Immigration: Employment-based immigration is permitted under US immigration law, allowing firms to sponsor foreign employees for specific types of positions and visas, such as H-1B visas for skilled workers.
  • Family Reunification: Family-sponsored immigration permits U.S. citizens and lawful permanent residents to petition for immigrant visas for specified family members to join them.
  • Humanitarian Relief:  Immigration provides humanitarian aid through programs, such as the Violence Against Women Act (VAWA) and special immigrant visas for specific populations. It is one of the immigration laws policies.
